Affiliated Businesses We Do Not Control. From time to time we may be affiliated with a variety of businesses and work closely with them. In certain situations, these businesses may operate stores at Maxxis Web site or sell items to you through Maxxis’ Web site. In other situations, Maxxis may provides services, or sell products jointly with affiliated businesses. Your Maxxis account personal information is protected by a password for your privacy and security. Credit Card Liability
Per the Fair Credit Billing Act, your bank cannot hold you liable for more than $50 of fraudulent charges. However, in the event of unauthorized use of your credit card number, you must notify your credit provider in accordance with the reporting rules and procedures listed in your account agreement.

SECURITY
Protecting your order information is our priority. Maxxis makes every effort to protect your online order information. Maxxis holds a Secure Server Certificate from VeriSign, the leading provider of Internet Trust Services. The Maxxis E-Store incorporates SSL (Secure Socket Layering), which protects all communications with our customers, so we can take credit card orders, and protect your sensitive personal information.

SSL security makes eavesdropping on web traffic almost impossible. SSL encrypts order information to avoid the decoding of that information by any party other than Maxxis. To check the security of your connection, look at the lower portion of your browser window after accessing the server. If you see an unbroken key or a closed lock, depending on your browser, then SSL is active. You can also double check by looking at the URL line of your browser. When accessing a secure server, the first characters of the site address will change from “http” to “https.” The “s” means it is secure.

Unless an incorrect product is shipped, we are unable to refund any shipping charges. Returns are only allowed up to 30 days after purchase. Merchandise ordered in error may be returned, freight prepaid by the consumer, for a full refund of the purchase price. Tires may not be mounted, marked, or used in any way. All merchandise will be inspected and must be returned unused and in original packaging.

There shall be no returns of Maxxis products without a return authorization number clearly marked on the outside of the package, or the item will be refused. WARRANTY
Merchandise with defective material or workmanship may be returned (freight prepaid by the consumer) for inspection according to the guidelines set forth by the Maxxis Limited Warranty.

Bicycle and Factory Gear Products
Warranty: Maxxis warrants to the original retail purchaser (“Purchaser”) of every new MAXXIS® brand bicycle tire purchased from Maxxis directly, including but not limited to the Maxxis website, and used exclusively in North America (“Tire”) that the Tire will be free from defect in material and workmanship for the shorter of six months from date of purchase or until there is no serviceable original tread depth (as determined at the reasonable discretion of Maxxis) remaining on the Tire (“Limited Warranty”).
Remedy: Maxxis will replace the defective Tire with a comparable new MAXXIS® brand tire, but shipping charges and any applicable taxes are not covered by the Limited Warranty. Only those products of current production models and appearing on a current price list shall be eligible for return.
Exclusions: The Limited Warranty does not apply to damage or defect relating to: (1) road hazards (such as cuts, snags, punctures, or bruises), impact breaks, Tire plugs and/or repair, vandalism, accidents, or abusive or unusual operating conditions, fire and/or chemical corrosion; (2) improper operation or maintenance such as, but not limited to, under or over-inflation, load, speed and inflation practices resulting in excessive operational conditions; (3) improper sizing, wheel alignment, Tire mounting or rim fit; or (4) bicycle mechanical problems (such as faulty, worn, or malfunctioning brakes).
Warranty Disclaimer: Except as stated above and unless otherwise provided by law, there is no warranty of merchantability or of fitness for a particular purpose or any other warranty, express or implied.
Limitation of Remedy: Replacement of the tire is the sole and exclusive remedy in the event of breach of any warranty or of any agreement relating to the tire.
Limitation of Liability: In no event shall Maxxis be liable for any incidental, indirect, special or consequential damages or liabilities (including but not limited to incidental or consequential damages for loss of time, inconvenience, loss of use of bicycle, or any other consequential or incidental loss) in connection with the purchase, use, or operation of the tire, whether due to a breach of warranty, breach of contract, or otherwise.
Warranty Claim Procedure: Purchaser may make a claim under this Limited Warranty by contacting Maxxis at 1.866.509.7067 to obtain a return authorization number and shipping instructions. Return of Maxxis products without a return authorization number clearly marked on the outside of the package will not be accepted.
Racing and Specialty Off-Road Tires
NOTE: MAXXIS RACING AND SPECIALTY OFF-ROAD TIRES THAT ARE CUT, GROOVED, BURNED OR UNDER-INFLATED ARE NOT COVERED UNDER THE MAXXIS LIMITED WARRANTY.

When purchasing from the Maxxis.com eStore:
Merchandise with defective material or workmanship may be returned to Maxxis International – USA, freight prepaid by the consumer, for inspection according to the guidelines set forth by the Maxxis Limited Warranty.

If tires qualify for replacement under the warranty guidelines, the full amount of the purchase will be refunded OR replacement tires will be shipped freight prepaid by Maxxis.  However, tires that are not found to be defective will be returned upon request freight prepaid by the customer.  If Maxxis does not receive a request for return or prepaid freight within 30 days of the final inspection report, Maxxis will dispose of the tires.
When purchasing from an Authorized Maxxis Dealer/Distributor:
A claim under the Maxxis Limited Warranty may be made by presenting to the Maxxis authorized dealer/distributor: the original proof of purchase for the tires; the tires that are the subject of the claim still mounted on the original vehicle; and the service maintenance records discussed in the Limited Warranty.

Trailer Tires
When purchasing from the Maxxis.com eStore:

Merchandise with defective material or workmanship may be returned to Maxxis International – USA freight prepaid by the consumer, for inspection according to the guidelines set forth by the Maxxis Limited Warranty.

In order to make a claim under the Maxxis Limited Warranty, you must deliver the allegedly defective tire to a Maxxis Authorized Tire Dealer in the United States for evaluation, along with a completed and signed Warranty Claim Form and proof-of-purchase date (such as trailer dealer invoice). You are responsible for payment of charges for services you request that are not covered in the Limited Warranty.

PURCHASING MAXXIS
Maxxis encourages you to purchase from a Maxxis Authorized Dealer if at all possible, to ensure professional advice and installation of our performance products. In order to make our performance products available in areas where there are no Maxxis Authorized Dealers, we are proud to offer a select number of products on-line. Currently, we offer our complete Bicycle product line, Maxxis Factory Authorized gear and selected Maxxis Trailer, Racing and Specialty Off-Road tires for on-line purchase via the Maxxis Factory eStore.

PAYMENT METHODS
Maxxis accepts all major credit cards for online orders.

SHIPPING METHODS
The Maxxis eStore accepts orders 24 hours a day, 7 days a week, and 365 days a year. However, our business offices are only open Monday-Friday 8 A.M.–5 P.M. (EST), excluding the following holidays: New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day (and the day after), Christmas Eve, Christmas Day. If any of these holidays falls on a Saturday, we will take the Friday before off. If a holiday falls on a Sunday, we will take the Monday after off.

If you place an order on a Saturday, it will not be processed until the following Maxxis business day. By choosing 2nd Day Air or Next Day Air, you understand that any orders placed after 1 P.M. (EST) will not be processed until the following business day.

All U.S. domestic orders will be shipped ground, unless otherwise specified. Ground orders can be expected to arrive in 5-7 business days after you receive your e-mail confirmation of your order in process.

TERMINATION
This Agreement is effective unless and until terminated by either you or Maxxis. You may terminate this Agreement at any time. Maxxis may also terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site if in Maxxis’ sole discretion, you fail to comply with any term or provision of this Agreement. Upon any termination of this Agreement by either you or Maxxis, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the terms of this Agreement or otherwise.
